1. Ownership of Platform Content

1.1 Trustiry's Intellectual Property

All content, features, and functionality of the Trustiry platform are owned by Bolrach Technologies Limited, a corporation incorporated in Canada and Nigeria, and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Protected Materials Include:

  • Software code, algorithms, and technical architecture
  • Website design, layout, and user interface
  • Graphics, logos, icons, and button designs
  • Text, documentation, and written materials
  • Audio, video, and multimedia content
  • Database compilations and data structures
  • Selection, coordination, and arrangement of content

1.2 Restrictions on Use

You may not, without our prior written permission:

2. User-Generated Content

2.1 Your Content Ownership

You retain ownership of all content you create and post on Trustiry, including reviews, ratings, comments, photos, videos, and other materials (collectively "User Content"). However, by posting User Content, you grant us certain rights as described below.

2.2 License Grant

By posting User Content on Trustiry, you grant Bolrach Technologies Limited a:

  • Worldwide - Valid in all countries
  • Non-exclusive - You can license your content to others
  • Royalty-free - No payment required from us
  • Perpetual - Continues indefinitely
  • Irrevocable - Cannot be withdrawn once granted
  • Transferable - Can be assigned to others
  • Sublicensable - We can license to third parties

This license allows us to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display your User Content in connection with operating and promoting the platform.

2.3 Your Representations

By posting User Content, you represent and warrant that:

  • You own or have the necessary rights to post the content
  • Your content does not infringe third-party intellectual property rights
  • You have obtained all necessary permissions and consents
  • Your content complies with all applicable laws and our Terms of Use
  • You have the authority to grant the license described above

2.4 Content Removal

While User Content remains publicly available on our platform, we may remove, edit, or disable access to any content at our sole discretion, including content that violates this Copyright Policy, our Terms of Use, or applicable laws.

  • Taglines and slogans associated with Trustiry
  • Product and service names
  • All related branding elements

You may not use our trademarks without our prior written permission. Any unauthorized use may constitute trademark infringement and violation of applicable laws.

All other trademarks, service marks, and logos displayed on the platform are the property of their respective owners.

4. Copyright Infringement Claims (DMCA)

⚖️ We Respect Copyright Laws

Trustiry complies with the Digital Millennium Copyright Act (DMCA), Canada's Copyright Act, and Nigeria's Copyright Act. We respond to valid copyright infringement notices and will remove infringing content when properly notified.

4.1 Filing a Copyright Infringement Notice

If you believe that content on Trustiry infringes your copyright, please send a written notice to our Copyright Agent with the following information:

  1. Identification of the copyrighted work - Describe the work you claim has been infringed, or if multiple works, provide a representative list.
  2. Identification of the infringing material - Provide the URL or specific location of the allegedly infringing content on our platform.
  3. Your contact information - Include your name, address, telephone number, and email address.
  4. Good faith statement - A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  5. Accuracy statement - A statement that the information in your notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
  6. Your signature - A physical or electronic signature of the copyright owner or authorized representative.

4.3 What Happens Next

We review your notice within 24-48 hours

We remove or disable the allegedly infringing content

3️⃣

We notify the user who posted the content

User may file a counter-notice (see below)

5. Counter-Notification Procedure

If you believe your content was removed or disabled by mistake or misidentification, you may file a counter-notification.

5.1 Counter-Notice Requirements

Your counter-notice must include:

  1. Your physical or electronic signature
  2. Identification of the content that was removed and its previous location
  3. A statement under penalty of perjury that you have a good faith belief the content was removed by mistake or misidentification
  4. Your name, address, telephone number, and email address
  5. A statement that you consent to the jurisdiction of the courts in Ontario, Canada
  6. A statement that you will accept service of process from the person who filed the original infringement notice

5.2 What Happens After Counter-Notice

Upon receiving a valid counter-notice:

  • We will forward your counter-notice to the original complainant
  • We will inform them they have 10-14 business days to file a court action
  • If no court action is filed, we will restore your content within 10-14 business days
  • If court action is filed, we will await the court's decision

⚠️ Warning: Filing a false or fraudulent counter-notice may result in legal liability. Consult with an attorney before filing a counter-notice if you are unsure.

6. Repeat Infringer Policy

🚫 Zero Tolerance for Repeat Offenders

We have a policy of terminating, in appropriate circumstances, the accounts of users who are repeat copyright infringers. We may also, at our discretion, suspend or terminate accounts of users who repeatedly violate this Copyright Policy.

7. False Claims

⚖️ Legal Consequences of False Claims

Under the DMCA and other applicable copyright laws, anyone who knowingly materially misrepresents that:

May be subject to liability for damages, including costs and attorneys' fees.

8.1 Applicable Laws
